AI governance · POPIA · On-premise AI
Artificial intelligence and the Protection of Personal Information Act are not opposites. IALE Institute helps South African organisations adopt AI with a lawful purpose, sound safeguards and a human in the loop, through governance frameworks, private AI systems and QCTO-accredited training.

Where AI meets POPIA
Most AI risk under POPIA is not exotic. It sits in four ordinary questions that a project team should answer before the first prompt is typed.
Purpose specification and minimality: only the personal information the use case needs, for a defined and lawful purpose.
Prompts sent to a cloud model may leave South Africa. Section 72 sets the conditions for transfers abroad.
Section 71 limits decisions based solely on automated processing that affect a person. Keep a human in the loop.
Section 19 requires appropriate safeguards; section 22 requires notification if personal information is compromised.
How we help
An AI policy, use-case register, risk assessment and approval process that your Information Officer can stand behind.
Private large-language-model systems trained on your internal knowledge, running on your infrastructure, so data never leaves it.
Review of the AI already in use: performance, bias and ethics audits, and the next round of improvements.
C5 Data Protection & Privacy (POPIA), E3 AI Governance, Ethics & Responsible Use, and C2 Cybersecurity Governance, Legislation & Compliance.
Method
| Step | What happens | Output |
|---|---|---|
| 1. Inventory | List the AI tools already in use, officially or not | AI use register |
| 2. Classify | Identify which use cases touch personal information | Risk-rated use cases |
| 3. Decide architecture | Cloud, private cloud or on-premise, case by case | Architecture decision |
| 4. Govern | Policy, approvals, human review and incident handling | AI governance framework |
| 5. Train | Staff learn what they may and may not put into AI tools | Trained, accountable users |
| 6. Review | Periodic audit of performance, bias and compliance | Audit report |
Questions
Yes, if the processing has a lawful basis and a defined purpose, personal information is minimised, security safeguards are in place, and cross-border transfers and automated decisions are handled as POPIA requires. It needs governance, not avoidance.
The conditions for lawful processing, including purpose specification and minimality; security safeguards (section 19); notification of security compromises (section 22); automated decision-making (section 71); and transfers of personal information outside South Africa (section 72).
With an own or on-premise AI system, your data never leaves your infrastructure, which removes the cross-border transfer question and keeps access under your security controls.
No. IALE provides AI governance, training and systems. Final compliance decisions belong to your Information Officer and legal advisers, and we work alongside them.
